1. Description of the service

Musikeando is an online platform for creating personalized, one-off songs to give to someone special on occasions such as birthdays, weddings, graduations, Mother’s Day, Valentine’s Day and other meaningful moments.

Our service uses artificial intelligence to compose original lyrics from the information you provide (the story, personal details, the musical style you want) and to generate unique musical versions. You can review and adjust the lyrics before the music is generated.

By using the platform you confirm that you agree to these Terms and Conditions and to our Privacy Policy.

2. Registration and user account

To use Musikeando you must create an account with truthful, complete and up-to-date information. You are responsible for keeping your access credentials confidential and for all activity carried out in your account.

Musikeando reserves the right to suspend or close accounts that breach these terms, without prior notice.

3. Use of the service and creation process

Creating a song on Musikeando follows these steps:

  • Submitting the story: you provide information about the person being celebrated, the occasion and the details you want the song to include.
  • Lyrics generation: the platform writes original lyrics based on what you provided. You can review them and ask for changes.
  • Music preview: musical versions are generated for you to listen to and pick your favourite. The first preview is free; further versions may be charged.
  • Purchase and download: once you have chosen, you pay and receive the high-quality audio file (MP3) to download.

You agree to use the service ethically and lawfully, and not to submit content that is offensive, defamatory or discriminatory, that incites violence, or that infringes the rights of others.

4. Usage rights and licence

When you buy a song on Musikeando you receive a personal, non-exclusive, non-transferable licence for private use of that song. This includes:

  • Listening to the song as many times as you like for personal use.
  • Sharing the song with the person it celebrates and with family or friends in a private setting.
  • Playing the song at private events (birthday parties, weddings and so on).

You may not:

  • Resell, sublicense or redistribute the song for commercial purposes.
  • Use the song in commercial productions, advertising or paid media without Musikeando’s prior written permission.
  • Register the song on music distribution platforms (Spotify, Apple Music and similar) as your own work.
  • Modify, remix or create derivative works from the song for commercial purposes.

5. Intellectual property

All content on the Musikeando platform — including but not limited to text, logos, design, source code, algorithms and artificial intelligence technology — is the intellectual property of Musikeando or its licensors, and is protected by Brazilian and international intellectual property law.

Songs created by the platform carry copyright shared between Musikeando (as creator of the musical composition and the technology) and you (as author of the concept and the story the lyrics came from). Musikeando reserves the right to use songs in anonymised form for demonstration and marketing purposes.

6. Payments, prices and plans

Musikeando offers different purchase plans (1, 2 or 3 songs) with prices shown clearly on the platform. In this market amounts are shown in US dollars (USD) and may be updated at any time without prior notice, with no effect on purchases already made.

Payments are processed securely through Stripe, which accepts credit and debit cards. Musikeando does not store card details on its servers.

Song credits bought in packs do not expire and can be used at any time while the service is active.

7. Refund policy

Given the personalized, digital nature of the product, Musikeando applies the following refund policy:

  • Before the song is generated: you can cancel and receive a full refund, provided music generation has not yet started.
  • After the song is generated: refunds are not available, as the digital product has already been delivered. However, if there is a demonstrated technical problem (corrupted file, generation failure), Musikeando will regenerate the song at no extra cost.
  • Unused credits: pack credits can be refunded in proportion to the credits not yet used, on request to support.

Refund requests must be sent to [email protected] within 7 (seven) days of purchase, as provided by the Brazilian Consumer Protection Code (art. 49).

8. Your responsibilities

You agree to:

  • Provide truthful, accurate information when registering and when creating songs.
  • Not use the service to create content that breaks the law, infringes the rights of others or offends public decency.
  • Not attempt to circumvent the platform’s security or payment systems.
  • Respect the intellectual property rights of Musikeando and of third parties.
  • Ensure you are authorised to share any third-party personal information used to create the song.

9. Limitation of liability

Musikeando works to deliver the best possible quality, but does not guarantee that:

  • The service will be available without interruption or free of errors.
  • The musical results will meet every subjective expectation.
  • Generated songs will be free of unintentional similarity to existing works.

Musikeando’s total liability for any claim arising from use of the service is limited to the amount actually paid for the song in question.

Musikeando is not liable for indirect, incidental, special or consequential damages arising from the use of, or inability to use, the service.

10. Availability and download

After purchase, the song’s audio file is available to download from your account. We recommend downloading it and keeping it somewhere safe. Musikeando undertakes to keep files available for at least 12 (twelve) months after purchase, but does not guarantee indefinite availability.

11. Changes to these terms

Musikeando reserves the right to change these Terms and Conditions at any time. Significant changes will be communicated by email or by notice on the platform. Continued use of the service after a change constitutes acceptance of the new terms.

12. Governing law and jurisdiction

These Terms and Conditions are governed by the laws of the Federative Republic of Brazil. Any dispute arising from them will be submitted to the courts of your place of residence, as established by the Brazilian Consumer Protection Code.
